Terms and Conditions
These Terms and Conditions govern all services provided by Vitality Electric to its customers. By requesting or using our services, you agree to be bound by the following terms.
- DEFINITIONS
1.1. The “Company” refers to Vitality Electric INC.
1.2. The “Customer” refers to the person or organization that engages the Company to perform services and/or supply materials.
1.3. The “Engineer” refers to the employee, technician, or authorized representative of the Company performing work for the Customer.
- GENERAL CONDITIONS
2.1. The Company reserves the right to refuse or decline any work at its discretion. Any accepted work will be assigned to an engineer of the Company’s choosing.
2.2. The Customer must notify the Company of the location of any hidden utility services (electrical, gas, water, telecommunications, etc.) prior to the start of work. The Company shall not be liable for damage or loss caused by undisclosed systems.
2.3. Wiring and cabling will be concealed when practical. If concealment is not feasible, surface-mounting may be used at the Company’s discretion.
2.4. The Customer must notify the Company in writing of any asbestos or similar materials on-site. If asbestos testing is required, it shall be at the Customer’s expense. Any work involving asbestos will be conducted by certified personnel in compliance with applicable laws.
2.5. The Customer is responsible for clearing obstructions prior to service. If Company assistance is needed for moving objects, this must be arranged in advance and may incur additional charges.
2.6. The Company may lift carpeting or flooring as needed and will use reasonable care. However, we are not liable for exact reinstallation. Professional refitting is recommended if required.
2.7. The Company does not provide painting, plastering, or decorating services. We can recommend professionals but are not responsible for their work.
- CHARGES AND PAYMENTS
3.1. Charges include labor, materials, and time spent acquiring special-order items.
3.2. Fixed-price work includes materials and labor, subject to applicable taxes. Estimates are valid for 30 days and may be revised if:
– Additional work is requested;
– Material prices increase;
– Unexpected site conditions arise;
– An error is discovered in the original estimate.
3.3. Invoices are due upon receipt unless agreed otherwise in writing with the Company.
3.4. Deposit Policy:
– Residential projects over $1,500 require a 10% deposit, due one week before work begins.
– Commercial projects over $3,000 require a 10% deposit, due one week before work begins.
The Company may withhold documentation (e.g., test reports) until full payment is received. This does not affect the Customer’s statutory rights.
Outstanding invoices over 30 days may be sent to collections, with additional recovery costs passed to the Customer.
Deposits are non-refundable if cancellation occurs less than 7 days before the scheduled start, unless the Company is at fault. Eligible refunds will be issued within 14 days.
4.SCHEDULING AND ACCESS
4.1. The Company will make reasonable efforts to ensure timely attendance but is not liable for delays.
4.2. If access is not granted at the scheduled time, a charge of $65 + tax will apply.
4.3. Standard working hours are Monday–Friday, 8:00 AM to 5:00 PM, unless otherwise agreed.
4.4. Any parking fees, tolls, or congestion zone charges incurred by the engineer will be added to the invoice.
- GUARANTEES AND WARRANTIES
5.1. The Company guarantees workmanship for 12 months from the date of job completion. Claims must be submitted in writing with supporting details.

The phone numbers obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
6.2. Types of SMS Communications
If you have consented to receive text messages from Vitality Electric, you may receive messages related to:
– Appointment reminders
– Follow-up messages
– Billing inquiries
– Promotions or offers (if applicable)
Example:
“Hello, this is a friendly reminder of your upcoming appointment with Vitality Electric on [Date] at [Time]. You can reply STOP to opt out at any time.
6.3. Message Frequency
Message frequency may vary depending on the type of communication.
6.4. Potential Fees for SMS Messaging
Standard message and data rates may apply based on your mobile carrier’s pricing plan. Fees may vary for domestic and international messages.
6.5. Opt-In Method
You may opt in to receive SMS messages from Vitality Electric through the following methods:
– Verbally, during a conversation
– By submitting an online form
– By filling out a paper form
6.6. Opt-Out Method
You can opt out at any time by replying “STOP” to any SMS message. You may also contact us directly to request removal from our messaging list.
6.7. Help
If you experience issues, reply with “HELP” for assistance or contact us directly.

- GOVERNING LAW
These Terms and all contracts between the Company and Customer shall be governed by the laws of the State of Texas and the State of California. Any disputes shall fall under the exclusive jurisdiction of those states’ courts.
